What to Do If You Have a Car Accident in Spain

Spain is generally considered a safe country to drive in, but accidents still occur. In 2023, there were 1,055 fatal accidents on Spanish roads, resulting in 1,160 deaths and 4,100 serious injuries. Knowing what to do in the event of a car accident is crucial for ensuring safety and compliance with Spanish law.

Steps to Take After an Accident

  1. Stay Calm and Visible:
    • Wear a reflective vest.
    • Move to a safe area near the accident scene.
    • Turn on emergency flashers and use warning triangles or a V-16 emergency beacon.
  2. Check for Injuries and Call for Help:
    • Ensure everyone is okay.
    • Call 112 for medical and police assistance if necessary.
  3. Avoid Modifying the Scene:
    • Do not move vehicles or victims unless there is an immediate danger.

If You Come Across an Accident

  • If Emergency Services Have Arrived: Continue your journey cautiously. Stopping to observe can cause additional hazards.
  • If You Are the First to Arrive: It is your duty to help the victims. Failure to assist is a serious offence under Article 195 of the Spanish Penal Code, punishable by a fine of three to twelve months.

If You Are Involved in the Accident

  1. Fill in the Accident Report:
    • Include personal details and those of the other drivers and vehicles.
    • Obtain statements and contact information from any witnesses.
    • Both parties must sign the report.
  2. Document the Scene:
    • Take pictures of the vehicles, damages, and road signs when it is safe to do so.
  3. Notify Your Insurance Company:
    • Report the accident within 7 days.
  4. Seek Medical Attention:
    • Visit a hospital or health centre for a medical report if injured or feeling unwell.
  5. Request Roadside Assistance:
