Electric scooters, or Personal Mobility Vehicles (PMVs), are increasingly common in Spanish cities, transforming urban transportation. Starting from January 2, 2026, all privately owned PMVs must have valid civil liability insurance to meet new legal standards.
Key Points:
- Legal Compliance: The requirement aligns with European Directive 2021/2118, aimed at enhancing road safety and ensuring fair compensation for accident victims.
- Current Situation: Less than 5% of privately owned e-scooters are currently insured, creating a significant safety and financial concern.
- Rising Incidents: Accidents involving PMVs are increasing, with some cities experiencing nearly double the number of incidents from 2023 to 2024. Since 2018, data shows a steady rise in accidents resulting in fractures, traumatic brain injuries, pedestrian injuries (particularly among the elderly), and property damage.
What the New Insurance Obligation Means for Users:
- Mandatory Registration: A national registry will be implemented in 2025, requiring all e-scooter owners to register their vehicles.
- Affordable Coverage: Basic civil liability insurance is expected to cost between €30 and €50 annually, depending on factors like speed, weight, and coverage level.
- Protection & Compensation: Insurance will cover damages such as:
- Minor repairs (clothing, phones)
- Serious injuries requiring medical treatment or rehabilitation
- Long-term disabilities
- Fatalities, with compensation up to €400,000
- Damage to vehicles and public property
Important Reminder:
Many users mistakenly believe their home insurance covers e-scooter accidents; however, most policies exclude motor vehicles like e-scooters. For minors, a parent or guardian must secure insurance and include the child as an insured person.
