Can You Eat or Drink While Driving in Spain? The Rules and Fines Explained

What the Law Says

Spain’s traffic regulations are primarily focused on ensuring that drivers maintain full control of the vehicle at all times. This means that any activity, including eating or drinking, that distracts you or impairs your ability to handle the car can be penalized under Spain’s Road Traffic Act.

For example:

  • Article 18 of the Spanish General Traffic Regulations states that the driver must maintain freedom of movement, a proper field of vision, and constant attention to the road.

Eating a sandwich, drinking coffee, or even reaching for a water bottle could be seen as distractions that reduce your ability to react quickly in case of an emergency.

The Fines for Distracted Driving

If a traffic officer deems that eating or drinking has distracted you from driving, you could face fines:

  • Fines for distracted driving can be up to €200.
  • Additionally, three points may be deducted from your driving license.

While the act of sipping water or munching on a snack might seem harmless, it could potentially lead to unsafe situations, especially in high-traffic areas or on highways.
